Jury Awards Ky. Couple Nearly $2.3 Million in Civil Suit Against Ky. Police

OAK GROVE, Ky. (AP) - The city of Oak Grove must pay nearly $2.3 million to a Fort Campbell couple, a federal jury in Paducah has decided.

The jury returned the verdict Nov. 5 in favor of Milo Rodgers, a Fort Campbell soldier, and his wife, Phyllis Rodgers.

The couple filed suit in October 2001, one year after Milo Rodgers sustained injuries during an Oct. 21, 2000, traffic stop.

The jury determined that two former Oak Grove patrolmen - Jeff Ford and Jason Pelphrey - and Chief Milton Perry used excessive force, violating Rodgers Fourth Amendment rights.

Oak Grove Mayor Colleen Ochs said she does not know if the city will appeal the verdict.

The case was among seven civil lawsuits filed in federal court against Oak Grove and its police department during 2001 and 2002. All alleged misconduct. Five cases were dismissed or settled, and one remains open pending the outcome of a separate criminal case.
