(OMAHA) -- A federal court jury decided last week that a career criminal didn’t have a case against the off-duty officer who, believing he was in danger, shot the burglar as he hurriedly exited an older couple’s home.
Paul Billingsley is serving a 10-to-12-year sentence for being a habitual criminal and probation violation. He was shot in the back in 1966 by an off-duty officer when, the officer said, Billingsley made a threatening motion towards him.
While the matter was cleared by internal affairs the burglar claimed that off-duty officer Fred Pfeffer used excessive force, the Associated Press reported.
