Video: Ohio cops fatally shoot robbery suspect who struck cruiser, drew replica gun

CLEVELAND — Officers have been cleared in the fatal shooting of a CVS robbery suspect.

A jury declined to bring criminal charges against Officers Stephen Krebs and Anthony Lavolpa for the fatal shooting of Devan Desnoyers.

“We do not believe that any reasonable judge or jury would find any criminal conduct in the police response to a suspect fleeing in his vehicle and drawing a firearm from his waistband,” a report said.

The officers pursued Desnoyers, 26, on Oct. 10. He was accused of robbing a local CVS and told a clerk he was armed, Cleveland.com reported. The pursuit ended when Desnoyers struck another officer’s cruiser.

Police said Desnoyers was holding a replica airsoft pistol when officers approached his car. When he refused to exit the vehicle, he was shot by police.

In the video, officers can be heard saying “he has a gun” or “has the gun.”

The officers told investigators they didn’t realize the gun was a replica. They said Desnoyers was looking down and had the gun raised when they approached.
