FARGO — Police released video of the officer-involved shooting of a man who pointed a replica gun at an officer, Grand Forks Herald reported.
The Sept. 28 incident occurred when Officer Patrick Thomas commanded the suspect, 31-year-old Karmen Redshirt, to drop the weapon, but he ignored orders. Redshirt had led police on a pursuit in a stolen vehicle.
Police told the publication the BB gun had a laser sight and looked like a real firearm.
Thomas fired three shots and hit Redshirt in the abdomen.
Redshirt was taken to a hospital and recovered after months of surgery.
A state attorney declined to indict Thomas and the department found his use of force justified.
Redshirt had a blood-alcohol level of 0.279 percent at the time of the shooting. He plead guilty to felony charges of theft, reckless endangerment, two counts of terrorizing and one misdemeanor of refusing to halt.
He was sentenced last month to four years in prison and three years of supervised probation.
