Special prosecutor says Ga. DA committed no crime in deputy assault allegation

ATLANTA- A special prosecutor cleared Fulton County’s district attorney Tuesday of criminal wrongdoing in a case in which a sheriff’s deputy accused him of assault during a courtroom confrontation.

The special prosecutor said there is no basis to submit the case against District Attorney Paul Howard to a grand jury.

Deputy Levoular McCray had complained she was assaulted by Howard on March 13 while attempting to take him into custody after a judge ordered him removed from a courtroom. Howard resisted and while waving his arms, injured McCray’s shoulder, according to incident reports.

Howard suggested Tuesday that he may pursue a false report claim against McCray.

McCray’s attorney said she is considering suing Howard.

Howard, 54, is serving his third term as district attorney for the county, which includes most of the city of Atlanta.
