INDIANAPOLIS — Dash cam video has been released of an October 2013 incident between an officer and a paraplegic man.

According to the Indy Channel, police were called to a school following reports of a man carrying a handgun in his backpack.

Police searched Nicholas Kincade, who is a paraplegic and wheelchair bound. Police did not find a gun, but did find a pocket knife.

Kincade was given a warning for trespassing. As Kincade left the scene, he rolled over Lt. Tom Davidson’s foot, who pushed Kincade in reaction.

Kincade’s wheelchair fell over, and he was charged with battery on a police officer.

The incident resulted in Davidson being placed on administrative leave. Officials later recommended him for termination following an investigation of the incident.

The Lafayette Police Civil Service Commission would later find Davidson guilty of unbecoming conduct, but chose not to move forward with a termination — opting to place him on 30-day unpaid suspension, a year of probation, and a loss of rank.

Charges against Kincade have been tossed.
