San Diego’s city attorney is claiming more than $25,000 in damages from a police officer whose patrol dog died in the back of a closed squad car on a hot day.
City Attorney Michael Aguirre said today the dog cost the city about $7,000.
He accused police Officer Paul Hubka, an 18-year veteran dog handler, of negligence. County investigators found the 5-year-old Belgian Malinois died of heatstroke in Hubka’s car, which the officer parked in his driveway after returning home.
A lawyer who represents Hubka called the claim a publicity stunt and says government workers can’t be sued for negligence.
The district attorney’s office is considering possible criminal charges.
