DALLAS — A Dallas County grand jury has cleared an officer of a fatal shooting this March that occurred when an unarmed man allegedly tried to strangle him.
Officer Clark Staller will not face criminal charges for the shooting death of Clinton Allen, 25.
Authorities say Staller, who was responding to a disturbance call, deployed his TASER twice, but it had no effect on Allen, who was on PCP at the time, according to the Dallas News.
Staller told investigators that he and Allen got into a physical altercation and flipped over a walkway railing as Allen began choking him from behind and lifting him off his feet. Staller pulled his gun and fatally shot Allen because he couldn’t breathe, police said.
Staller was treated for injuries to his throat and for a concussion, according to the report.
“There’s never been any doubt that Officer Staller’s actions were justified,” said Zach Horn, Staller’s attorney. “He was in a fight for his life, and we’re very fortunate that Officer Staller survived and that he’s still with us today.”
