OAKLAND, Calif. — A man is filing a lawsuit against the Oakland Police Department after he says his name was mistakenly on the ‘Most Wanted’ list for six months.

Chau Van, 37, claims his reputation was “irreparably harmed” by the error, while the department has defended its actions, saying Van is still an identified suspect for an incident in which a man was nearly beaten to death with a baseball bat in December 2011, according to Fox News.

Van’s name and image first appeared during a Feb. 7, 2012, news conference on Oakland gang violence, in which Police Chief Howard Jordan said he was wanted for a shooting.

Van went to the department a week later to clear his name, and was held in custody for three days before being released.

An investigation into the beating, which Van was never charged for, is ongoing.
