IDAHO FALLS, Idaho — After an extensive investigation, a Bonneville County prosecutor concluded Bonneville police were justified in the shooting a suspect, Idaho State Journal reported.
Ricky Mosley was shot June 29 after he failed to comply with officers’ repeated commands and appeared to physically threaten them.
“After a review of all the evidence that has been presented, I find that law enforcement were justified in their use of deadly force. A reasonable prudent officer in a similar situation would be expected to act similarly,” Prosecuting Attorney Daniel R. Clark said in a press release..
The incident began when officers were responding to a domestic violence report. Mosley, the perpetrator, was located off the scene at a gas station.
When Mosley exited his truck, officers were unable to determine whether or not he had a weapon in his hands behind his back. According to the report, he refused to show officers his hands or tell them what he was holding.
A deputy was getting into position to TASER Mosley when he leaped at officers and pulled his hands into a shooting position while holding a black object. The object was later determined to be a non-working cell phone.
Officers fired a total of 22 rounds, five struck Mosley. Mosley was injured, but is in stable condition at the hospital. A blood sample from June 29 showed he also tested positive for alcohol. He has been charged with domestic battery.
