TALLAHASSEE, Fla. — A student at Florida State University is claiming campus police used excessive force on him during a traffic stop in December.
WCTV reports that 20-year-old Kyle Knapp was stopped on December 22 for an expired tag. Officer Brian Cutcliffe smelled alcohol on Knapp as he spoke with him.
Dash cam footage from the incident shows Officer Cutcliffe repeatedly request that Knapp step out of his vehicle. Knapp refused to do so multiple times.
Once Knapp was on the ground, he also refused to put his hands behind his back, according to the report.
Officers then deployed a TASER twice as they tried to put Knapp in handcuffs.
FSU Police Spokesman Jim Russell said, “Through our training coordinator who’s an expert in response resistance it was reviewed. Based on our review, we found it was reasonable and necessary as far as the officer’s actions.”
Knapp was charged with DUI, resisting arrest with violence, and battery on a law enforcement officer.
Assistant State Attorney Wade White later dropped the charges against Knapp after reviewing the dash cam, according to WCTV.
Knapp’s lawyer, Don Pumphrey, claims his client never resisted.
