While performing the Horizontal Gaze Nystagmus test during roadside sobriety testing, consider having the suspect sit on the rear bumper of your patrol unit with his legs somewhat extended. The legs should be positioned such that they can’t quickly be used to spring forward but should not be extended so far as to require you to straddle them while testing. This will allow you to perform the HGN while keeping the subject in a position that would make the launch of an attack more difficult.
